Anti-dumping II. Restrictions that inspire with hope

On November 23, 2010, the Russian Government adopted Enactment #929 on the Measures of protecting Russian producers of nickel-bearing flat-rolled stainless steel.

Prehistory:

·          March 25, 2009: the Russian Ministry for Trade and Industry initiated an anti-dumping investigation into imports of nickel-bearing stainless steel flat products sourced from Brazil, China (Taiwan), South Korea, South African Republic.

·         July 16, 2009: same Ministry held hearings on the case where Spetsstal Association participated as a party.

·        March 26, 2010 (12 months later): same Ministry prolonged the investigation for 3 months until 27 June 2010.

·       June 21, 2010: same Ministry published results of the investigation.

·       August 5, 2010: the governmental committee for customs tariff regulation and protective measures, chaired by deputy prime minister Victor Zubkov, backed the imposition of an anti-dumping duty on nickel-bearing stainless steel flat products, sourced from South Africa, Brazil, South Korea and China for as long as 3 years.

·     23 November 2010, the Government adopted an Enactment #929.

In brief, what the applicants desired and what the government decided eventually:

Thus, the desired rate of an anti-dumping duty has been downsized 2-5 times while the period when the duty is in effect has been decreased from 5 to 3 years. However, the most important is the Addendum to the Enactment #929, namely, a list of nickel-bearing stainless steel flat products that have been freed from the imposition of the anti-dumping duty…
